Terms of Service

1The Service

Truebode provides tools that help home buyers and real estate professionals organize and evaluate home-condition information and related decisions. The Service is in beta: it is available by invitation, and features will change, break, and sometimes disappear.

2Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is currently offered for use in the United States.

3Accounts

You are responsible for the accuracy of your account information and for keeping your credentials secure. If you receive an invitation link, keep it confidential and do not pass it to anyone other than its intended recipient.

4Fees

The Service may be offered free of charge, for a fee, or as a mix of free and paid features, and this may differ by area, by role, and over time. We may introduce, change, or withdraw prices, plans, free tiers, and promotions at any time. Any price is shown at the point of purchase and handled by a third-party payment processor. Where a subscription is offered, it renews automatically until cancelled from your billing page in the Service, and cancellation takes effect at the end of the current billing period. One-time purchases are consumed when used. Refunds, if any, are as described at the point of purchase; otherwise fees are non-refundable except where required by law. A price change does not affect a period you have already paid for, and if we discontinue the Service during a period you have paid for, we will refund the unused portion.

5Your content

You retain all rights to the content you upload or create in the Service (“Your Content”). You grant us a non-exclusive, worldwide license to host, store, reproduce, process, and display Your Content as needed to operate the Service, including processing through third-party providers and displaying shared content to the people you share it with.

You represent that you have the necessary rights to upload and share Your Content. Documents such as inspection reports may belong to their author or be licensed only to certain people; you, not Truebode, are responsible for having the rights to use them here. Content you share with others becomes part of their records and may remain visible to them even if you later edit or delete it.

6De-identified data

We may create and use aggregated, de-identified data derived from use of the Service to operate and improve it. This right survives termination.

7Informational use only

Output of the Service, including any figures, summaries, or suggestions, may be generated with automated and AI-assisted tools. It is informational only, may be incomplete or inaccurate, and is not a quote, bid, appraisal, or guarantee. The Service does not provide legal, financial, tax, engineering, construction, home inspection, or real estate brokerage advice, and no fiduciary or client relationship is created with us. Verify important information independently and consult qualified professionals. Decisions in a real estate transaction are yours and your advisors’ alone, and licensed professionals remain fully responsible for their own professional obligations.

8Acceptable use

Do not:

• use the Service in violation of law or the rights of others;
• upload content you lack the rights to, or content containing malware;
• attempt to probe, breach, or overload the Service, or access another user’s data;
• reverse engineer the Service except where the law permits it despite this term;
• misrepresent your identity or use an invitation that was not meant for you.

We may suspend or terminate accounts that violate this section.

9Our intellectual property

The Service and everything we provide through it belong to us or our licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service and nothing more. If you send us feedback, we may use it without obligation to you.

10Beta status

THE SERVICE IS A BETA RELEASE. It may be unavailable, may change, and may lose data, and it comes with no service level commitment. Keep your own copies of anything you cannot afford to lose. We may modify, suspend, or discontinue the Service or any feature at any time; if we discontinue it, we will make reasonable efforts to give you notice and a chance to export Your Content.

11Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR THE OUTCOME OF ANY REAL ESTATE TRANSACTION OR NEGOTIATION; AND (B) OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13Indemnification

You will defend and indemnify us against third-party claims arising from Your Content or your breach of these Terms.

14Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access for breach of these Terms, or on notice as part of winding down the beta. Sections that by their nature should survive (including 5 through 7, 9, and 11 through 16) survive termination.

15Changes to these Terms

We may update these Terms as the product evolves. For material changes we will give notice by email or in the Service before they take effect; continued use after that is acceptance. We may assign these Terms, including to a legal entity formed to operate Truebode or in a financing or acquisition. You may not assign them without our consent.

16Governing law and disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict of laws rules. Before filing any claim, reach us through the contact form on our website and give us 30 days to try to resolve the dispute informally. Any claim not resolved informally will be brought in the state or federal courts located in New Mexico, and both parties consent to their jurisdiction.

17Miscellaneous

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
